One Year Trial Program - Question and Answer
Q: Does "Lease" mean Lease-Purchase?
A. No. The Lease-Purchase of school buses is not legal in New York State. This is a straight leasewhich is legal per the “sunset” provision of chapter 472 of the laws of 1998 (c. 57, L.2005)-Leasing of School Buses (S. 36.80-A/Saland).
Q: Is voter approval required for a one year lease?
A. No. A one year lease does not require voter approval, however, you may not re-lease the same unit, or a like unit, the next year without voter approval.
Q: When would the district be required to make the lease payment?
A. The total annual lease payment would be due at the time of delivery and acceptance of the unit. There is no arrears option.
Q: Can the bus specifications be specific to our school district?
A. Yes, if the lease commitment is received by New York Bus Sales prior to December 31, 2007. This allows New York Bus Sales time to build, inspect and deliver your unit to the district in July 2008.
Q: Can the district take delivery later in the year and thus shorten the lease period and decrease the cost to the district?
A. Yes & No. The length of the lease period can be shortened by the district however because the annual lease payment is based on the residual value of the unit after one year the payment amount cannot be decreased
Q: Are there any mileage restrictions?
A. Yes. The lease figure is based on 18,000 miles per year. If the district has specific mileage requirements, higher or lower, we can easily accommodate them.
Q: If we like the bus and want to buy it after the lease period what is required?
A. Since the Lease Purchase of school buses is prohibited in New York, once the lease period is over so are all transactions concerning the equipment.
Q: What do we do if we are not satisfied with the product or your service?
A. This program was developed because we are so confident in all of the Blue Bird products as well as the New York Bus Sales Service and Parts departments that you have to do nothing at the end of the lease should you want to return the equipment.
Q: Will there be additional liability incurred by the district?
A. Yes. The additional liability would be the cost normally incurred by the addition of one unit to the fleet. For example an insurance rider will be required in the amount equal to the total value for the unit. Also, any damage beyond normal wear and tear will be the responsibility of the district.
Q: Could we lease the unit for longer than one year?
A. Yes. The law allows for leasing up to five years, with voter approval. Arrangements need to be made at the beginning of the lease agreement for any period longer than one year.
Q: Are other Blue Bird products available under this program?
A. Yes. All of the Blue Bird products can be “test driven” under this program. That includes the Type D All American Transits, the Type C Vision Conventional and the Type A Ford or Chevy Microbird products.
